The idea that you can completely disinherit your spouse or your children, particularly if they are minor children, is something that is governed by Florida law.

Your spouse has certain rights such as elective share, or homestead rights, or maintenance rights that you may not be able to completely eliminate under the terms of your will. It’s important that you seek out legal counsel on this issue as there may be other documents that could impact this, such as prenuptial or post-nuptial agreements.
